For almost half a century, Ukrainian history did not exist in Ukraine as an independent field of scholarly research or as a subject of instruction. After the Second World War, the “history of the Ukrainian SSR” was established as a regional subunit of the “History of the USSR.” Outside Ukraine, its history was a subject of scholarly research and ideological interpretation in diaspora historiography and in a few small universitylevel institutions that generally found themselves on the margins of the academic world. After 1991, public demand for accounts of Ukrainian history arose in Ukraine and abroad: in both cases, the motives were purely pragmatic and instrumental. In Ukraine, the overriding concern was to legitimize the state in ideological and “scholarly” terms and provide for the civic education of the nation, which took the form of “creating Ukrainians.” Beyond the borders of the new state, interest in its history was inspired by efforts to understand and explain the current situation: thus, most Western research on Ukraine concentrates on studies in politics, international affairs, economics, and sociology, while historical works are generally either popular outlines or highly specialized investigations.

FLA/FAIFE places great importance on its biennial World Report. This carefully researched survey provides the information professions with a regular insight into the state of intellectual freedom worldwide as it relates to libraries. It seems to be the nature of the sector that few out and out causes celebres emerge (although a few could be named). The world of journalism is a constant ferment of dangerous and threatening activity, and book publishing produces difficult cases all the time. Internet problems feature prominently in the press and on the Internet itself. Yet it might be possible to assume that libraries exist in an intellectual freedom safe haven. Unfortunately this is not the case. Libraries also share in the threats to privacy and the restrictions on access that trouble the world of knowledge and communication generally. Possibly because the threats creep up on libraries and are often experienced at second hand (for instance, through the suppression of a book or the blocking of a website), they are easier to ignore. The World Report is intended to open our eyes, alert us to dangers and enable us to fight emerging threats or support colleagues in other parts of the world.

The tragic events of 11 September 2001 have led to an intensification of measures against terrorism both at the level of states and international organisations. New laws and resolutions have been passed in order to strengthen national and international action against terrorism. Some of these measures violate human rights and have been introduced without respect for obligatory procedures under international human rights conventions for derogations in cases of emergency. This development has given rise to much concern worldwide. In order to analyse the many (human rights) questions posed by the intensified struggle against terrorism, a symposium was organised, on the initiative of the Marangopoulos Foundation for Human Rights (MFHR) of Athens, by the European Training and Research Centre for Human Rights and Democracy (ETC) in Graz and the Diplomatic Academy of Vienna together with the MFHR. This volume brings together most of the contributions to this high-level and in-depth discussion in edited, updated form. Among the issues analysed are the dangers entailed in the new doctrine of pre-emptive wars, the issue of the prevention of terrorism through measures addressing its causes and the strengthening of human security. The volume also contains an annex with major documents relating to the question of human rights and terrorism at universal and regional levels prepared by international organisations and NGO's, which represents a useful handbook on the topic. In keeping with NIJ's mission of generating research-based knowledge that can inform policy and benefit practitioners, this Research Report presents a broad-based collection of papers representative of NIJ's portfolio of gang-related research. It emphasizes program evaluation. Bain Attwood's Rights for Aborigines is an important addition to the evolving canon on the interrelationships between white and indigenous Australians. His project provides timely scholarship on the discontinuities of the historical struggle of indigenous Australians to participate in a politically sanctioned, and mediated, liberal present. Attwood's approach is to select key case studies as 'representative' (p. xiv) of the development of indigenous engagement with white activists, and white ideas of justice, equality and fairness, in order to overcome colonial disadvantage. These case studies are ordered chronologically to provide clarity on the fractured discursive development of ideas like 'aboriginality' within a coherent temporal framework. They are significant within themselves, focusing on key historical struggles, for example, Coranderrk in the 1870s, the 1938 Day of Mourning, the 1967 referendum, and Tent Embassy in 1972, and will provide that most useful of references — a thorough account of a series of interconnected events with an intelligent analysis — for scholars of history, political science and law. The stand out, in terms of investigating closely the complex ways in which ideas of racial equality changed for both white and indigenous Australians as a result of their close working relationships, was the chapter on the Wave Hill strike. The careful reading of the narratives of engagement set up by CPA writer Frank Hardy with the Gurindji, in particular Vincent Lingiari, allows Attwood to investigate the individualised elements of political and psychological change, while still showing how probably the most politically significant discourse of recent times, land rights; emerged.

Such incidences of promissory fraud are frequently litigated because they can result in punitive damages awards. And an insincere promisor can even be held criminally liable. This book defines and explains the operation of the defense of change of position in Anglo-Australian law. It is a widely accepted view that the defense is a modern development, the first express recognition of which can be traced in England to the seminal decision of the House of Lords in Lipkin Gorman (a firm) v Karpnale Ltd. From local trial courts to the United States Supreme Court, judges' decisions affect the fates of individual litigants and the fate of the nation as a whole. Scholars have long discussed and debated explanations of judicial behavior. This book examines the major issues in the debates over how best to understand judicial behavior and assesses what we actually know about how judges decide cases. It concludes that we are far from understanding why judges choose the positions they take in court. Lawrence Baum considers three issues in examining judicial behavior. First, the author considers the balance between the judges' interest in the outcome of particular cases and their interest in other goals such as personal popularity and lighter workloads. Second, Baum considers the relative importance of good law and good policy as bases for judges' choices. Finally Baum looks at the extent to which judges act strategically, choosing their own positions after taking into account the positions that their fellow judges and other policy makers might adopt. Baum argues that the evidence on each of these issues is inconclusive and that there remains considerable room for debate about the sources of judges' decisions. Baum concludes that this lack of resolution is not the result of weaknesses in the scholarship but from the difficulty in explaining human behavior. He makes a plea for diversity in research. Western students have observed that religion and magic pervade not only the forms of Tibetan art, politics, and society, but also every detail of ordinary human existence. And what is the all-pervading religion of Tibet? The Buddhism of that country has been described to us, of course, but that does not mean the question has been answered. The unique importance of Stephan Beyer's work is that it presents the vital material ignored or slighted by others: the living ritual of Tibetan Buddhists. The reader is made a witness to cultic proceedings through which the author guides him carefully. He does not force one to accept easy explanations nor does he direct one's attention only to aspects that can be counted on to please. He leads one step by step, without omitting anything, through entire rituals, and interprets whenever necessary without being unduly obtrusive. Oftentimes, as in the case of the many hymns to the goddess Tara, the superb translations speak directly to the reader, and it is indeed as if the reader himself were present at the ritual. If any blame attaches to this book, it is that it presents itself too modestly. It is, in fact, the first major work on the core of Tibetan life. I do not want to imply that all the most meaningful things in Tibetan culture or religion have been overlooked by others. The author begins his work with a discussion of great Western scholars who have studied Tibet before him. Few students, however, have been able or willing to deal extensively with the cultic procedures of Tibetan Buddhism. Instead they have focused on other subjects, such as the sublime paintings and sculptures of Tibet, the philosophical texts, the biographies of saints. These subjects are no doubt important, but their treatment has too often left the general impression of Tibetan religion as a collection of primitive customs and odd superstitions.
