The wider peacebuilding field has long suffered under the weight of an intriguing paradox: Violence has never been more studied, understood in terms of its dynamics and patterns, and officially identified as a policy challenge than it has in past the twenty years. And violence continues to unfold with extraordinary resilience in too many communities around the world. In this book Joe Bock makes a significant step into unpacking and suggesting creative ways to respond to this dilemma. I say that as a practitioner- scholar with thirty years of experience in community conflict and as a critic of the difficulties that this promising area of exploration — all too often misnamed as conflict prevention — has failed to deliver. From the standpoint of the practice of strategic peacebuilding several key contributions are worth highlighting from this book.

Im Mittelpunkt der Untersuchung stehen militärgerichtliche Strafverfahren gegen Zivilpersonen. Die Frage, inwiefern solche Verfahren mit dem Recht auf ein faires Verfahren vereinbar sind, beschäftigt internationale Spruchkörper und Gremien seit längerem.PrüfungsmaÃstab sind drei Konventionen: die EMRK, die AMRK und der Internationale Pakt über bürgerliche und politische Rechte. Die Arbeit systematisiert zunächst die vorhandene Spruchpraxis. Sie geht sodann der Frage nach, ob es ein Recht auf ein zuständiges Gericht gibt bzw. wie sich ein solches Recht konstruieren lässt. Ausführungen zu besonderen Problemen im Kontext von Ausnahmezuständen und eine Betrachtung der U.S.-amerikanischen Militärkommissionen im Nachtrag runden die Analyse ab.

This book deals with critical aspects of English historical, constitutional and political thought from the Middle Ages to the early modern period. In particular, the book is a study of the ways in which history could be deployed for all kinds of political purposes. The entire story of the historical construct of the "radical ancient constitution" is told, focusing on the ways in which rebels turned to important medieval sources including the so-called "Laws" of Edward the Confessor, in an effort to legitimize resistance, deposition and regicide.

In February 1933, Adolf Hitler had only a tenuous grasp on power. Chancellor of Germany for merely four weeks, he led a fragile coalition government. The Nazis had lost seats in the Reichstag in the recent election, and claimed only three of thirteen cabinet posts. Then on February 27th, arson sent the Reichstag, the home and symbol of German democracy, up in flames. Immediately blaming the Communists, Hitler's new government approved a decree that tore the heart out of the democratic constitution of the Weimar Republic and cancelled the rule of law. До видання, підготовленого до 75-річчя Інституту історії України НАН України, вміщено документи, що дають уявлення про багатовимірне життя Інституту та доробок науковців за період від часу заснування установи у 1936 р. до 1991 р., коли із здобуттям Україною незалежності відбувся історіографічний злам. У першій книзі опубліковані документи, що розкривають життя Інституту та його співробітників у найтрагічніше десятиліття його існування — від відомої постанови ЦК КП(б)У від 23 липня 1936 р. про заснування науководослідної установи історичного профілю в системі Академії наук УСРР — до іншої, сумнозвісної постанови ЦК КП(б)У “Про політичні помилки і незадовільну роботу Інституту історії України Академії наук УРСР” від 29 серпня 1947 р. Упорядники чимало уваги приділи реконструкції втраченого архіву Інституту періоду до 1943 р.; висвітленню діяльності структурних підрозділів Інституту, в тому числі його Львівського відділу; мовою документів намагались показати життя істориків в роки окупації України вермахтом як в евакуації в Уфі, так і в окупованих Києві та Львові; а також відобразити особливості історіографічного процесу перших повоєнних років.
