The Gay Rights Question in Contemporary American Law offers an unusually nuanced analysis of the most pressing gay rights issues. Does antigay discrimination violate the Constitution? Is there any sound moral objection to homosexual conduct? Are such objections the moral and constitutional equivalent of racism? Must state laws recognizing same-sex unions be given effect in other states? Should courts take account of popular resistance to gay equality? Koppelman sheds new light on all these questions. INFORMATION TECHNOLOGY IS CONSIDERED A MAJOR THREAT TO privacy because it enables pervasive surveillance, massive databases, and lightning- speed distribution of information across the globe. In fact, privacy has been one of the most enduring social issues associated with digital electronic information technologies. A fi xture in public discourse at least since the 1960s, when the dominant concern was massive databases of government and other large institutions housed in large stand- alone computers, concerns have multiplied in type and extent as radical transformations of the technology have yielded the remarkable range of present- day systems, including distributed networking; the World Wide Web; mobile devices; video, audio, and biometric surveillance; global positioning; ubiquitous computing; social networks; sensor networks; databases of compiled information; data mining; and more. Associated with each of these developments is a set of worries about privacy.

This book intervenes in contemporary debates about the threat posed to democratic life by political emergencies. Must emergency necessarily enhance and centralize top-down forms of sovereignty? Those who oppose executive branch enhancement often turn instead to law, insisting on the sovereignty of the rule of law or demanding that law rather than force be used to resolve conflicts with enemies. But are these the only options? Or are there more democratic ways to respond to invocations of emergency politics? Looking at how emergencies in the past and present have shaped the development of democracy, Bonnie Honig argues that democracies must resist emergency's pull to focus on life's necessities (food, security, and bare essentials) because these tend to privatize and isolate citizens rather than bring us together on behalf of hopeful futures. Emphasizing the connections between mere life and more life, emergence and emergency, Honig argues that emergencies call us to attend anew to a neglected paradox of democratic politics: that we need good citizens with aspirational ideals to make good politics while we need good politics to infuse citizens with idealism. Honig takes a broad approach to emergency, considering immigration politics, new rights claims, contemporary food politics and the infrastructure of consumption, and the limits of law during the Red Scare of the early twentieth century. Taking its bearings from Moses Mendelssohn, Franz Rosenzweig, and other Jewish thinkers, this is a major contribution to modern thought about the challenges and risks of democratic orientation and action in response to emergency.

This entertaining read is about the word "fuck", the law, and the taboo. Whether you shout it out in the street or whisper it in the bedroom, deliberately plan a protest, or spontaneously blurt it out, if you say "fuck," someone wants to silence you, either with a dirty look across the room or by making a rule that you cannot say the word. When it's the government trying to cleanse your language, though, you should worry. Words are ideas. If the government controls the words we use, it can control what we think. To protect this liberty, we must first understand why the law's treatment of "fuck" puts that freedom at risk. This book examines the law surrounding the word and reveals both inconsistencies in its treatment and tension with other identifiable legal rights that the law simply doesn't answer. The power of taboo provides the framework to understand these uncertainties. It also explains why attempts to curtail the use of "fuck" through law are doomed to fail. Fundamentally, it persists because it is taboo; not in spite of it.

Lopez focuses on two related events in 1960s California politics that prompted the brown-power movement that fuels contemporary Latino consciousness. When Mexican American high-school students in East Los Angeles launched a protest against the horrid conditions in their schools, school officials and local politicians sought to punish a few students to discourage spreading discord. About the same time, a group of Mexican protestors were charged with conspiracy involving fires set during a speech by then governor Ronald Reagan at a Los Angeles hotel. Lopez argues that the conspiracy charge, the backlash against the Mexican students, and subsequent trials challenging the status quo of California race relations also challenged the until-then popular notion among Mexicans that they were white and sparked the brown-race consciousness. Lopez explores the intersection of the law and racial politics that points out the glaring racism extant in practices of the time. What is a human right? How can we tell whether a proposed human right really is one? How do we establish the content of particular human rights, and how do we resolve conflicts between them? These are pressing questions for philosophers, political theorists, jurisprudents, international lawyers, and activists. James Griffin offers answers in his compelling new investigation of the foundations of human rights. First, On Human Rights traces the idea of a natural right from its origin in the late Middle Ages, when the rights were seen as deriving from natural laws, through the seventeenth and eighteenth centuries, when the original theological background was progressively dropped and 'natural law' emptied of most of its original meaning. By the end of the Enlightenment, the term "human rights" (droits de l'homme) appeared, marking the purge of the theological background. But the Enlightenment, in putting nothing in its place, left us with an unsatisfactory, incomplete idea of a human right. Griffin shows how the language of human rights has become debased. There are scarcely any accepted criteria, either in the academic or the public sphere, for correct use of the term. He takes on the task of showing the way towards a determinate concept of human rights, based on their relation to the human status that we all share. He works from certain paradigm cases, such as freedom of expression and freedom of worship, to more disputed cases such as welfare rights--for instance the idea of a human right to health. His goal is a substantive account of human rights--an account with enough content to tell us whether proposed rights really are rights. Griffin emphasizes the practical as well as theoretical urgency of this goal: as the United Nations recognized in 1948 with its Universal Declaration, the idea of human rights has considerable power to improve the lot of humanity around the world. We can't do without the idea of human rights, and we need to get clear about it. It is our job now--the job of this book--to influence and develop the unsettled discourse of human rights so as to complete the incomplete idea.

The civil rights movement was first and foremost a struggle for racial equality, but questions of gender lay deeply embedded within this struggle. Steve Estes explores key groups, leaders, and events in the movement to understand how activists used race and manhood to articulate their visions of what American society should be. Estes demonstrates that, at crucial turning points in the movement, both segregationists and civil rights activists harnessed masculinist rhetoric, tapping into implicit assumptions about race, gender, and sexuality. Estes begins with an analysis of the role of black men in World War II and then examines the segregationists, who demonized black male sexuality and galvanized white men behind the ideal of southern honor. He then explores the militant new models of manhood espoused by civil rights activists such as Malcolm X and Martin Luther King Jr., and groups such as the Nation of Islam, the Student Nonviolent Coordinating Committee, and the Black Panther Party. Reliance on masculinist organizing strategies had both positive and negative consequences, Estes concludes. Tracing these strategies from the integration of the U.S. military in the 1940s through the Million Man March in the 1990s, he shows that masculinism rallied men to action but left unchallenged many of the patriarchal assumptions that underlay American society.

In the early 1960s, American conservatives seemed to have fallen on hard times. McCarthyism was on the run, and movements on the political left were grabbing headlines. The media lampooned John Birchers's accusations that Dwight Eisenhower was a communist puppet. Mainstream America snickered at warnings by California Congressman James B. Utt that "barefooted Africans" were training in Georgia to help the United Nations take over the country. Yet, in Utt's home district of Orange County, thousands of middle-class suburbanites proceeded to organize a powerful conservative movement that would land Ronald Reagan in the White House and redefine the spectrum of acceptable politics into the next century. Suburban Warriors introduces us to these people: women hosting coffee klatches for Barry Goldwater in their tract houses; members of anticommunist reading groups organizing against sex education; pro-life Democrats gradually drawn into conservative circles; and new arrivals finding work in defense companies and a sense of community in Orange County's mushrooming evangelical churches. We learn what motivated them and how they interpreted their political activity. Lisa McGirr shows that their movement was not one of marginal people suffering from status anxiety, but rather one formed by successful entrepreneurial types with modern lifestyles and bright futures. She describes how these suburban pioneers created new political and social philosophies anchored in a fusion of Christian fundamentalism, xenophobic nationalism, and western libertarianism. While introducing these rank-and-file activists, McGirr chronicles Orange County's rise from "nut country" to political vanguard. Through this history, she traces the evolution of the New Right from a virulent anticommunist, anti-establishment fringe to a broad national movement nourished by evangelical Protestantism. Her original contribution to the social history of politics broadens--and often upsets--our understanding of the deep and tenacious roots of popular conservatism in America.
