For almost half a century, Ukrainian history did not exist in Ukraine as an independent field of scholarly research or as a subject of instruction. After the Second World War, the “history of the Ukrainian SSR” was established as a regional subunit of the “History of the USSR.” Outside Ukraine, its history was a subject of scholarly research and ideological interpretation in diaspora historiography and in a few small universitylevel institutions that generally found themselves on the margins of the academic world. After 1991, public demand for accounts of Ukrainian history arose in Ukraine and abroad: in both cases, the motives were purely pragmatic and instrumental. In Ukraine, the overriding concern was to legitimize the state in ideological and “scholarly” terms and provide for the civic education of the nation, which took the form of “creating Ukrainians.” Beyond the borders of the new state, interest in its history was inspired by efforts to understand and explain the current situation: thus, most Western research on Ukraine concentrates on studies in politics, international affairs, economics, and sociology, while historical works are generally either popular outlines or highly specialized investigations.

Justice and Reconciliation in Post-Apartheid South Africa assesses the transitional processes under way since the early 1990s to create a stable and just society. Change in South Africa is often credited to the efforts of the Truth and Reconciliation Commission (TRC), but the work of this institution forms but a facet of a much broader picture. This book looks at the steps which accompanied and followed the TRC's activities, such as land restitution, institutional reforms and social and cultural initiatives. Thematically, it interlinks the TRC's concerns over truth and reconciliation with an analysis of the concepts of justice, accountability, harm and reconciliation and with competing perceptions of what these notions entail in the South African context. In 2000 a beheaded journalist was found in a remote forest near Kyiv. The corpse led to a scandal when it was revealed that it was that of a journalist critical of the authorities. The President was heard on tapes made covertly in his office ordering violence to be undertaken against the journalist. The scandal led to the creation of a wide protest movement that culminated in the victory of democratic opposition parties in 2002. The democratic opposition, led by its presidential candidate Viktor Yushchenko, fought a bitter and fraudulent election campaign in 2004 during which he was poisoned. Widespread election fraud led to Europe's largest protest movement since the Cold War which became known as the Orange Revolution, known after the campaign colour of the democratic opposition. This book is the first to provide a collection of studies surveying different aspects of the rise of the Ukraine's democratic opposition from marginalization, to protest against presidential abuse of office and culminating in the Orange Revolution. It integrates the Kuchmagate crisis of 2000-2001 with that of the Orange Revolution four years later providing a rich, detailed and original study of the origins of the Orange Revolution.

This volume offers a number of forensic indicators of election fraud applied to official election returns, and tests and illustrates their application in Russia and Ukraine. Included are the methodology's econometric details and theoretical assumptions. The applications to Russia include the analysis of all federal elections between 1996 and 2007 and, for Ukraine, between 2004 and 2007. Generally, we find that fraud has metastasized within the Russian polity during Putin's administration with upwards of 10 million or more suspect votes in both the 2004 and 2007 balloting, whereas in Ukraine, fraud has diminished considerably since the second round of its 2004 presidential election where between 1.5 to 3 million votes were falsified. The volume concludes with a consideration of data from the United States to illustrate the dangers of the application of our methods without due consideration of an election's substantive context and the characteristics of the data at hand.

The paper conducts a critical analysis of the potential legal basis and scope of the future European Union (EU)-Ukraine enhanced agreement. Accepting that the most probable and most beneficial possibility for Ukraine is to conclude an association agreement with the EU on the basis of Article 310 EC Treaty (EC), it is argued that the objectives of the enhanced co-operation between the EU and Ukraine - as expected and desired by the Ukrainian political élite - could be achieved by a partnership agreement concluded on the basis of Article 181a EC. Furthermore, if the new enhanced EU-Ukraine agreement were concluded as a partnership agreement, it might be better suited for the solving of certain political and legal challenges in contemporary EU-Ukraine relations. First, a new enhanced agreement concluded on the basis of Article 181a EC would not entail unjustified political expectations - on the part of Ukraine - of obtaining the perspective of full EU-membership in the near future. Second, a future EU-Ukraine partnership agreement would be the best option for a “transitional” enhanced agreement before the Treaty of Lisbon enters into force. Third, a future partnership agreement between the EU and Ukraine will not undermine the fundamentals of the evolving strategic partnership between the EU and Russia.
