Arbitration is an essential component in business. In an age when transparency is a maxim, important issues which the laws governing arbitration currently fail to address are the extent to which disclosure of information can be constrained by private agreement along with the extent to which the duty to preserve confidentiality can be stretched. Absent a coherent legal framework and extensive qualitative and quantitative data, it is equally difficult to suggest and predict future directions. How has the International Criminal Court (ICC) been able to evolve into a fairly effective, albeit relatively untested multi-level model of global governance? This volume explores this question and the novel predicament it represents for understanding the challenges of extending globalgovernance and promoting global justice. It focuses on the novel dynamics and design of the ICC and the role played by realpolitik factors such as the UN Security veto and intra-state competition in shaping and testing the cosmopolitan dimensions of the Court. To study these focal points and tounderstand the political challenges shaping the policies of the ICC, the book adopts a synergistic model based on four levels of responsibility, ranging from the state's negative responsibility not to harm its own citizens to the positive, open-ended global responsibility of the ICC Prosecutor. Themodel offers the basis of the book's cutting-edge, innovative approach, a "cosmopolitan political realism" , which encompasses and interweaves four International Relations theoretical perspectives: rationalism, constructivism, communicative action theory, and cosmopolitanism. Guiding this model isthe metaphor of the switch levers of train tracks, in which the Prosecutor and Judges serve as the agents switching (and criss-crossing) the tracks of realpolitik and cosmopolitanism. In the quarter-century since this book first appeared, there have been few moments of uncertainty as to the direction of international relations and international law to compare with the early years of the twenty-first century. Globalisation has brought undoubted benefits in the fields of commerce, technology and communications, but also increased dangers concerning the rapid spread of disease and the growth of international terrorism. The clearly understood rules and limitations as to state conduct apparent during the ColdWar period have disappeared and (for the moment at least) the optimism engendered by a renewed United Nations in the early 1990s has dissipated. Increasing resort to force by states, entities and individuals coupled with the apparently easy access to weapons of high destructive capacity pose a significant challenge to those wishing to establish a world order based on justice,mutual respect, toleration and forbearance.

Economic, social and cultural rights (ESC rights) are protected in several international human rights instruments, the most comprehensive being the International Covenant on Economic, Social and Cultural Rights (ICESCR or ‘the Covenant’), which has been ratified by a vast majority of states. One of the most recent developments with respect to the international protection of ESC rights has been the unanimous adoption on 10 December 2008 by the United Nations General Assembly of an Optional Protocol to the International Covenant on Economic, Social and Cultural Rights (GA resolution A/RES/63/117).

As the first Prosecutor of the International Criminal Court, I believe the engagement of academic communities with the operational problems of the Court will be invaluable, particularly by introducing new theoretical frameworks to explain and confront the complicated challenges that the implementation of the Rome Statute presents.

Вважається, що в наш час обсяг інформації подвоюється приблизно кожні десять років. Робота з нею неможлива без різноманітних автоматичних пристроїв, головну роль серед яких відіграє комп'ютер. Комп'ютер — це електронний пристрій для програмованої обробки інформації. Слово “комп'ютер” до нас надійшло з англійської мови (computer — обчислювач, тобто пристрій, який виконує обчислення). Спершу комп'ютери призначалися для автоматичного розв'язання математичних задач, їх називали електронно-обчислювальними машинами, скорочено ЕОМ. Але з розвитком технічних засобів комп'ютер став не тільки обчислювальною машиною. У сучасному розумінні комп'ютер призначений для опрацювання, зберігання інформації будь-якого типу. Це зумовило широке використання комп'ютерів в усіх, без винятку, галузях діяльності людини.
