The tragic events of 11 September 2001 have led to an intensification of measures against terrorism both at the level of states and international organisations. New laws and resolutions have been passed in order to strengthen national and international action against terrorism. Some of these measures violate human rights and have been introduced without respect for obligatory procedures under international human rights conventions for derogations in cases of emergency. This development has given rise to much concern worldwide. In order to analyse the many (human rights) questions posed by the intensified struggle against terrorism, a symposium was organised, on the initiative of the Marangopoulos Foundation for Human Rights (MFHR) of Athens, by the European Training and Research Centre for Human Rights and Democracy (ETC) in Graz and the Diplomatic Academy of Vienna together with the MFHR. This volume brings together most of the contributions to this high-level and in-depth discussion in edited, updated form. Among the issues analysed are the dangers entailed in the new doctrine of pre-emptive wars, the issue of the prevention of terrorism through measures addressing its causes and the strengthening of human security. How can a promise be a lie? Answer: when the promisor never intended to perform the promise. Such incidences of promissory fraud are frequently litigated because they can result in punitive damages awards. And an insincere promisor can even be held criminally liable. Yet courts have provided little guidance about what the scope of liability should be or what proof should be required. Homicide was the third leading cause of occupational injury death in the U.S. for the period from 1980 through 1985, accounting for nearly 13% of the nation's total deaths from trauma in the workplace. Homicide was the manner of death for 12% if the men and 42% of the women who died from injuries sustained in U.S. workplaces during the 6-year period for which data were available at the time of the workshop.

Christopher Bennett presents a theory of punishment grounded in the practice of apology, and in particular in reactions such as feeling sorry and making amends. He argues that offenders have a 'right to be punished' - that it is part of taking an offender seriously as a member of a normatively demanding relationship (such as friendship or collegiality or citizenship) that she is subject to retributive attitudes when she violates the demands of that relationship. However, while he claims that punishment and the retributive attitudes are the necessary expression of moral condemnation, his account of these reactions has more in common with restorative justice than traditional retributivism. He argues that the most appropriate way to react to crime is to require the offender to make proportionate amends. His book is a rich and intriguing contribution to the debate over punishment and restorative justice.

In this book, David E. Brandt examines the legal, psychological, and cultural issues relevant to understanding antisocial behavior in adolescence. Based on his own research and a broad analysis of recent work in the field, Brandt identifies the factors that are common in cases of delinquency. The discussion considers the long-term effects of social issues such as poverty as well as psychological issues such as the high levels of stress and anxiety suffered during childhood by many delinquents. He shows how a failure to meet the developmental needs of children—at both the family level and at a broader social and political level—is at the core of the problem of juvenile delinquency. Brandt concludes with an inquiry into how best to prevent delinquency. Programs that address the developmental needs of children, Brandt argues, are more effective than policing, juvenile courts, or incarceration.

This volume assembles recent perspectives and fresh approaches in the field of criminology. Despite its social importance, the topic of the significance of race and gender in the law of torts has not received sustained attention largely because, on its surface, the world of torts appears divided between those who suffer injury and those who inflict injury, categories that are race and gender neutral. To be sure, there is a vague awareness that particular social groups are more likely to sustain certain types of injuries, for example, that women are disproportionately hurt by domestic violence and that African American children are at greater risk than white children of suffering injury from exposure to lead paint. However, the conventional wisdom is that the legal rules, concepts, and structures for liability no longer take account of the race or gender of the parties.

Children of almost any age can break the law, but at what age should children first face the possibility of criminal responsibility for their alleged crimes? This work is the first global analysis of national minimum ages of criminal responsibility (MACRs), the international legal obligations that surround them, and the principal considerations for establishing and implementing respective age limits. Taking an international children's rights approach, with a rich theoretical framework and the vitality of the UN Convention on the Rights of the Child, this work maintains a critical perspective, such as in challenging the assumptions of many children's rights scholars and advocates. Compiling the age limits and statutory sources for all countries, this book explains the broad historical origins behind most of them, identifying the recurring practical challenges that affect every country and providing the first comprehensive evidence that a general principle of international law requires all nations, regardless of their treaty ratifications, to establish respective minimum age limits.
