Bain Attwood's Rights for Aborigines is an important addition to the evolving canon on the interrelationships between white and indigenous Australians. His project provides timely scholarship on the discontinuities of the historical struggle of indigenous Australians to participate in a politically sanctioned, and mediated, liberal present. Attwood's approach is to select key case studies as 'representative' (p. xiv) of the development of indigenous engagement with white activists, and white ideas of justice, equality and fairness, in order to overcome colonial disadvantage. These case studies are ordered chronologically to provide clarity on the fractured discursive development of ideas like 'aboriginality' within a coherent temporal framework. They are significant within themselves, focusing on key historical struggles, for example, Coranderrk in the 1870s, the 1938 Day of Mourning, the 1967 referendum, and Tent Embassy in 1972, and will provide that most useful of references — a thorough account of a series of interconnected events with an intelligent analysis — for scholars of history, political science and law. The stand out, in terms of investigating closely the complex ways in which ideas of racial equality changed for both white and indigenous Australians as a result of their close working relationships, was the chapter on the Wave Hill strike. The careful reading of the narratives of engagement set up by CPA writer Frank Hardy with the Gurindji, in particular Vincent Lingiari, allows Attwood to investigate the individualised elements of political and psychological change, while still showing how probably the most politically significant discourse of recent times, land rights; emerged.

In photographs Karl Marx and Abraham Lincoln both look the part of the respectable Victorian gentleman. But they were almost diametrically opposed in their attitude toward what was called at the time the social question. Lincoln happily represented railroad corporations as a lawyer. As a politician he was a champion of free wage labor. Karl Marx, on the other hand, was a declared foe of capitalism who insisted that wage labor was in fact wage slavery, since the worker was compelled by economic necessity to sell his defi ning human attribute—his labor power—because if he did not, his family would soon face hunger and homelessness.

Does democracy reduce state repression as human rights activism, funding, and policy suggest? What are the limitations of this argument? Investigating 137 countries from 1976 to 1996, State Repression and the Domestic Democratic Peace seeks to shed light on these questions. Specifically, it finds that electoral participation and competition generally reduces personal integrity violations like torture and mass killing; other aspects of democracy do not wield consistent influences. This negative influence can be overwhelmed by conflict, however, and thus there are important qualifications for the peace proposition.

Americans cannot live with judicial review, but they cannot live without it. There is something characteristically American about turning the most divisive political questions - like freedom of religion, same-sex marriage, affirmative action, and abortion - into legal questions with the hope that courts can answer them. In Judicial Review in an Age of Moral Pluralism Ronald C. Den Otter addresses how judicial review can be improved to strike the appropriate balance between legislative and judicial power under conditions of moral pluralism. His defense of judicial review is predicated on the imperative of ensuring that the reasons that the state offers on behalf of its most important laws are consistent with the freedom and equality of all persons. Den Otter ties this defense to a theory of constitutional adjudication based on John Rawls's idea of public reason and argues that a law that is not sufficiently publicly justified is unconstitutional, thus addressing when courts should invalidate laws and when they should uphold them even in the midst of reasonable disagreement about the correct outcome in particular constitutional controversies.

According to the introduction, every nation has a constitution or a set of documents that serves as one. In each of these, the fundamental "rules" of the country--the defining principals of its government--are laid out in one form or another. It would be difficult to make any other generalizations concerning these documents and the information they contain. Each is unique in itself, while performing a similar function. The very nature of the material makes it challenging for a casual or inexperienced researcher to make comparisons. This set, in a sense, deconstructs these constitutions in a straightforward style. Entries for 194 countries are arranged A-Z. The articles for each country are signed and in many cases are written by scholars who specialize in the country they are writing about. The structure of each article follows a pattern designed to make it easy to compare information from one country to another. Each begins with a small collection of information about the country: name, capital, languages spoken, ethnic composition, type of government, and date of constitution, among others. A brief overview of the country is followed by standard subsections: "Constitutional History," "Form and Impact of the Constitution," "Basic Organizational Structure," "Leading Constitutional Principles," "Constitutional Bodies," and so on. Articles range from 4 to 13 pages in length, and each concludes with links to the text of the constitution in its original language (and, if needed, an English translation) and secondary sources for further reading. At the end of volume 3 are several useful appendixes. One gives the same kind of constitutional information for the European Union, and the second provides a list and description of "Special Territories" such as Antarctica, the Cook Islands, Guam, and the Isle of Man. The third is a glossary of terms.

The civil rights movement was first and foremost a struggle for racial equality, but questions of gender lay deeply embedded within this struggle. Steve Estes explores key groups, leaders, and events in the movement to understand how activists used race and manhood to articulate their visions of what American society should be. Estes demonstrates that, at crucial turning points in the movement, both segregationists and civil rights activists harnessed masculinist rhetoric, tapping into implicit assumptions about race, gender, and sexuality. Estes begins with an analysis of the role of black men in World War II and then examines the segregationists, who demonized black male sexuality and galvanized white men behind the ideal of southern honor. He then explores the militant new models of manhood espoused by civil rights activists such as Malcolm X and Martin Luther King Jr., and groups such as the Nation of Islam, the Student Nonviolent Coordinating Committee, and the Black Panther Party. Reliance on masculinist organizing strategies had both positive and negative consequences, Estes concludes. Tracing these strategies from the integration of the U.S. military in the 1940s through the Million Man March in the 1990s, he shows that masculinism rallied men to action but left unchallenged many of the patriarchal assumptions that underlay American society.

This entertaining read is about the word "fuck", the law, and the taboo. Whether you shout it out in the street or whisper it in the bedroom, deliberately plan a protest, or spontaneously blurt it out, if you say "fuck," someone wants to silence you, either with a dirty look across the room or by making a rule that you cannot say the word. When it's the government trying to cleanse your language, though, you should worry. Words are ideas. If the government controls the words we use, it can control what we think. To protect this liberty, we must first understand why the law's treatment of "fuck" puts that freedom at risk. This book examines the law surrounding the word and reveals both inconsistencies in its treatment and tension with other identifiable legal rights that the law simply doesn't answer. The power of taboo provides the framework to understand these uncertainties. It also explains why attempts to curtail the use of "fuck" through law are doomed to fail. Fundamentally, it persists because it is taboo; not in spite of it.

This book argues that the Supreme Court performs two functions. The first is to identify the Constitution's idealized "meaning." The second is to develop tests and doctrines to realize that meaning in practice. Bridging the gap between the two--implementing the Constitution--requires moral vision, but also practical wisdom and common sense, ingenuity, and occasionally a willingness to make compromises. In emphasizing the Court's responsibility to make practical judgments, Implementing the Constitution takes issue with the two positions that have dominated recent debates about the Court's proper role. Constitutional "originalists" maintain that the Court's essential function is to identify the "original understanding" of constitutional language and then apply it deductively to current problems. This position is both unwise and unworkable, the book argues. It also critiques well-known accounts according to which the Court is concerned almost exclusively with matters of moral and constitutional principle. Implementing the Constitution bridges the worlds of constitutional theory, political theory, and constitutional practice. It illuminates the Supreme Court's decision of actual cases and its development of well-known doctrines. It is a doctrinal study that yields jurisprudential insights and a contribution to constitutional theory that is closely tied to actual judicial practice.

In these volumes, 310 alphabetically arranged articles range in length from 500 to 3,500 words and cover 198 regions ("including every independent nation and several territories") as well as international courts, supranational institutions, concepts central to understanding political organization and human rights, and key individuals who have had positive and negative impacts on the evolution of citizens' rights and responsibilities. Country entries describe the system of government and the political evolution, with emphasis on the twentieth century and on issues related to the relationship between government and citizen. Each signed article concludes with a bibliography. The credentials of the authors (mostly academicians) are provided in the directory of contributors. Sidebars and black-and-white maps and illustrations break up the text. Same-page definitions in the margins of terms (such as ethnic cleansing, guerrilla, and republic make the information more comprehensible, as does the glossary, which is repeated at the end of each volume. In addition, each volume includes a cumulative index and a thematic outline of topics so that users can easily locate information on relevant persons, documents, legal issues, and concepts, as well as country-specific data and history, and teachers can plan correlated assignments. Another useful feature is the filmography, which is arranged by country. What is a human right? How can we tell whether a proposed human right really is one? How do we establish the content of particular human rights, and how do we resolve conflicts between them? These are pressing questions for philosophers, political theorists, jurisprudents, international lawyers, and activists. James Griffin offers answers in his compelling new investigation of the foundations of human rights. First, On Human Rights traces the idea of a natural right from its origin in the late Middle Ages, when the rights were seen as deriving from natural laws, through the seventeenth and eighteenth centuries, when the original theological background was progressively dropped and 'natural law' emptied of most of its original meaning. By the end of the Enlightenment, the term "human rights" (droits de l'homme) appeared, marking the purge of the theological background. But the Enlightenment, in putting nothing in its place, left us with an unsatisfactory, incomplete idea of a human right. Griffin shows how the language of human rights has become debased. There are scarcely any accepted criteria, either in the academic or the public sphere, for correct use of the term. He takes on the task of showing the way towards a determinate concept of human rights, based on their relation to the human status that we all share. He works from certain paradigm cases, such as freedom of expression and freedom of worship, to more disputed cases such as welfare rights--for instance the idea of a human right to health. His goal is a substantive account of human rights--an account with enough content to tell us whether proposed rights really are rights. Griffin emphasizes the practical as well as theoretical urgency of this goal: as the United Nations recognized in 1948 with its Universal Declaration, the idea of human rights has considerable power to improve the lot of humanity around the world. We can't do without the idea of human rights, and we need to get clear about it. It is our job now--the job of this book--to influence and develop the unsettled discourse of human rights so as to complete the incomplete idea.

Liberal theories have long insisted that cultural diversity in democratic societies can be accommodated through classical liberal tools, in particular through individual rights, and they have often rejected the claims of cultural minorities for group rights as illiberal. Group Rights as Human Rights argues that such a rejection is misguided. Based on a thorough analysis of the concept of group rights, it proposes to overcome the dominant dichotomy between "individual" human rights and "collective" group rights by recognizing that group rights also serve individual interests. It also challenges the claim that group rights, so understood, conflict with the liberal principle of neutrality; on the contrary, these rights help realize the neutrality ideal as they counter cultural biases that exist in Western states. Group rights deserve to be classified as human rights because they respond to fundamental, and morally important, human interests. Reading the theories of Will Kymlicka and Charles Taylor as complementary rather than opposed, Group Rights as Human Rights sees group rights as anchored both in the value of cultural belonging for the development of individual autonomy and in each person’s need for a recognition of her identity. This double foundation has important consequences for the scope of group rights: it highlights their potential not only in dealing with national minorities but also with immigrant groups; and it allows to determine how far such rights should also benefit illiberal groups. Participation, not intervention, should here be the guiding principle if group rights are to realize the liberal promise.
