Глава держави посідає чільне місце в системі вищих органів державноївлади і справляє на їх формування та функціонування визначальний вплив.Роль президента в системі органів державної влади і в країні загалом значноюмірою залежить від того, якою саме є форма республіканського правління –президентською, парламентарною чи змішаною. Конституційний статус(інститут) президента, а отже, і роль президента у здійсненні державної влади,залежить від форми республіканського правління. Досягнення цієї мети ірозв'язання зумовлених нею завдань є особливо важливими для України,оскільки узагальнення зарубіжного досвіду формування і функціонуванняінституту президентства дає змогу удосконалювати такий інститут в нашійкраїні.Актуальність теми дисертаційного дослідження зумовлюєтьсяреформуванням інституту президента у відповідності з об'єктивнимивимогами, які висуваються до нього у зв'язку з політико-правовими змінами удержавному житті України, а також виникають у процесі пошуку оптимальноїдля країни форми республіканського правління.Метою дисертаційного дослідження є виокремити, розкрити зміст таз'ясувати особливості функціонування інституту президентства за різнихформ республіканського правління. Об'єктом дисертаційного дослідження єінститут президентства як сукупність юридичних норм, що визначає статуспрезидента як глави держави за республіканської форми правління.Предметом дослідження виступають особливості інституту президентства зарізних форм республіканського правління.^UThe head of state occupies a prominent place in the system of higher stateauthority and exerts a decisive influence on their formation and functioning. In thecountry the role of the president in the system of public authority depends on whatform of republican government is the presidential, the parliamentary or the semipresidential.The constitutional status (the institute) of the president and the role ofthe president, in the exercise of state power, depends on the form of republicangovernment. Achieving this goal and solving the tasks are especially important forUkraine, as the generalization of foreign experience in the formation and functioningof the institute of presidency makes it possible to improve such an institute in ourcountry.The relevancy of the dissertation is coordinated to the reform of the president`sinstitute in accordance with the objective requirements for it in connection withpolitical and legal changes in state life of Ukraine, as well as arise in the process offinding the optimal form of republican government.The purpose of the dissertation is to single out, reveal the content and find outthe peculiarities of the functioning of the institute of presidency under the differentforms of republican government. The object of the dissertation is the institute ofpresidency as a set of legal norms that determines the status of the president as thehead of state under the republican form of government. The subject of the study arethe features of the institute of presidency in the different forms of republicangovernment.The dissertation is the first complex political science research of the instituteof presidency under the different forms of republican government. Within theframework of the conducted research the following results were obtained, which aremarked by scientific novelty and are submitted for defense:for the first time:- the author's definition and delimitation of the concepts “the institute ofpresidency” and “the president's institute” is given. The institute of presidency is aset of constitutional norms that determine the place and role of the president in thesystem of public authority in states with a republican form of government, and thepresident's institute is a system of constitutional law that determines the status ofthe president in the system of public authority in a particular country. The conceptof “the institute of presidency” is broader in meaning than the concept of “thepresident's institute”, as it covers both the general characteristics of theconstitutional status of the president as the head of state in different countries andthe status of the president in a particular country. The constitutional status of thepresident is a part of the president's institute. The constitutional status of thepresident is a set of functions, powers and forms of responsibility enshrined in thebasic law, and the president's institute is a system of constitutional and legal normsthat determines the constitutional and legal status of the president in the system ofpublic authority in a particular country. The study of the president's institute in theconstitutions of countries should be carried out taking into account the generalcharacteristics of the institute of presidency.
